Terms of Service, Disclaimer, and Limitation of Liability

These Terms, together with our Privacy Policy (available at https://domistiq.com/privacy), govern your access to and use of the Service. By using the Service, you also agree to the terms of our Privacy Policy.

These Terms of Service ("Terms") govern your access to and use of Domistiq (the "Service"), provided by Youtilitics ("we," "us," or "our"), headquartered in Ventura, California. By creating an account, downloading the app, or otherwise using the Service you accept and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Account” means a user account registered with Domistiq. “User Content” means content you submit, upload, or create using the Service (for example: calendar events, tasks, photos, chore boards). “Paid Services” means any subscription or paid features offered through Domistiq.

2. Description of Service

Domistiq is a family organization tool that helps households plan and coordinate (calendars, imports, school schedules, reminders, shared tasks, glanceable displays, gamified chores, and voice assistant integrations). The Service is available via web and mobile apps and may include optional integrations with third-party services.

3. Eligibility

You must be at least the minimum legal age in your jurisdiction to form a binding contract to use the Service. If you are a parent or guardian creating an account on behalf of a family, you represent that you have the right to provide personal information for any family members you add. Domistiq is not intended for use by children under 13 without parental consent.

Domistiq is not directed to children under the age of 13. If you are under 13, you may not use the Service without verifiable parental consent obtained in accordance with applicable law (including the Children's Online Privacy Protection Act). We do not knowingly collect personal information from children under 13 without such consent. Parents or guardians are responsible for supervising any use by minors and may review or request deletion of their child's information as described in our Privacy Policy.

If you are a parent or guardian, you are responsible for your children's compliance with these Terms. You are responsible for reviewing the privacy policies and terms of use of any third-party services used by your children through the Service.

4. Account Registration & Security

To access certain features you must register for an Account. You agree to provide accurate information and keep credentials confidential. You are responsible for all activity on your Account. Notify us immediately of any unauthorized use.

You retain ownership of User Content you post to the Service. By submitting User Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display the content as necessary to provide and operate the Service (including across devices in your family). You represent that you have the right to provide the content and that it does not violate third-party rights or applicable law.

This license can be used to display the content to other users associated with your Account (e.g., family members) as part of the Service's functionality.

8. Third-Party Integrations

The Service may integrate with third-party software or services (e.g., calendar providers, voice assistants). Those integrations are provided "as is." We are not responsible for the functionality, accuracy, availability, or data handling practices of third parties. Connecting a third-party account may share relevant data with that service — review their privacy terms before connecting.

We are not responsible for any errors, omissions, or data loss resulting from the integration with third-party services, including but not limited to errors in data synchronization or voice command misinterpretations.

9. Intellectual Property

All trademarks, service marks, logos, software, designs, text, graphics, and other content provided by Domistiq are owned by Youtilitics or its licensors and protected by intellectual property laws. You are granted a limited, revocable, non-transferable license to use the Service for personal/family purposes only.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. INFORMATION, INCLUDING IMPORTED SCHOOL SCHEDULES OR THIRD-PARTY DATA, MAY BE INACCURATE OR OUT-OF-DATE. YOU RELY ON THE SERVICE AT YOUR OWN RISK.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER-IMPORTED OR THIRD-PARTY DATA, INCLUDING SCHOOL SCHEDULES.

The Service is a convenience tool only. It is not a safety, emergency, or life-critical application. You should not rely solely on the Service for time-sensitive or critical life events (e.g., medical appointments, school pickups, or legal deadlines).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOUTILITICS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS) ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR, IF YOU HAVE NOT PAID US, ONE HUNDRED DOLLARS ($100)). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE CASES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

This limitation applies regardless of the legal theory on which the claim is based.

12. Indemnification

You agree to indemnify, defend, and hold harmless Youtilitics and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (i) your use of the Service; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of third-party rights.

13. Termination

We may suspend or terminate your Account or access to the Service for violation of these Terms or for any other reason in our sole discretion, subject to applicable law., with or without notice. On termination, we may disable your access and delete or retain User Content as described in our Privacy Policy. You may close your Account at any time via account settings or by contacting support; certain subscription fees may remain non-refundable as set out in our billing terms.

14. Modifications to the Service

We may modify, update, or discontinue features of the Service at any time. We will attempt to provide notice for material changes, but are not required to do so. Continued use after the effective date of changes constitutes acceptance.

15. Governing Law, Venue & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Except where prohibited by local consumer law, you agree that disputes will be resolved exclusively in the state or federal courts located in Ventura County, California. If you are a consumer in a jurisdiction that provides mandatory protections, those protections will apply notwithstanding this section.

16. Assignment

We may assign or transfer our rights and obligations under these Terms (for example, in connection with a merger or sale). You may not assign these Terms without our prior written consent.

17. Miscellaneous

These Terms constitute the entire agreement between you and Youtilitics concerning the Service and supersede prior agreements. Failure to enforce a provision is not a waiver. If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Force majeure excuses performance for events beyond reasonable control.

California Residents: If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt-out of the sale/sharing of your personal information. Please see our Privacy Policy for details on how to exercise these rights.

If you are a consumer in the European Union or other jurisdictions with mandatory local laws, those protections may apply in addition to these Terms where required.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will post an updated version with a new effective date and, where appropriate, provide notice. Continued use of the Service after changes indicates acceptance of the new Terms.
